In this privacy statement, we inform you about the personal data we process, how we collect it, and for what purposes we do this. Additionally, we inform you about your rights as a data subject.

Who are we?

We are the ChipNL Competence Centre, a collaboration between Brainport Development, Chiptech Twente, High Tech NL, Imec, Jeppix, OostNL (representative on behalf of BOM and Innovation Quarter).  At TNO. Supported by the European Union and the Dutch Government. The ChipNL Competence Centre is the expertise hub for companies in the Dutch semiconductor industry. Here, SMEs, startups, and scale-ups have direct access to knowledge, technology, and networks that are crucial for innovation and growth. We assist companies in accelerating, collaborating, and expanding internationally within the European semiconductor sector.

We attach great importance to carefully protecting personal data within this dynamic environment. The ChipNL Competence Centre processes personal data exclusively in accordance with applicable laws and regulations, in particular the General Data Protection Regulation (GDPR) and the GDPR Implementation Act (UAVG).

Definitions

This privacy statement contains some (legal) terms. Below you will find an overview of these terms and their meanings.

Involved:

The person whose personal data is processed by the ChipNL Competence Centre.

Recipient:

A third party to whom the personal data is disclosed.

Personal data:

All information that directly or indirectly reveals something about a person (data subject). This includes a name, email address, location data, as well as one or more elements that are characteristic of the identity, such as height, hair color, political preferences, or a combination thereof.

Processing:

Activities related to personal data, such as organizing, structuring, storing, updating, or modifying or deleting personal data. This means that (almost) everything done with personal data constitutes processing.

Processor:

An organization that is engaged to process personal data on behalf of the ChipNL Competence Centre, for example for payroll administration.

Data controller:

The data controller determines the purpose and means of processing personal data. When the ChipNL Competence Centre decides 'why' and 'how' personal data should be processed, the ChipNL Competence Centre will be the data controller.


From whom do we process personal data?

The ChipNL Competence Centre processes personal data of various individuals. This may include:

  • Visitors to our website;

  • Visitors to our events;

  • Interested parties;

  • Our (business) partners;

  • Our staff and applicants.

Which personal data do we process?

ChipNL Competence Centre processes various types of personal data. Examples include:

  • Personal details (name, address, place of residence, and email address);

  • Data about your activities on our website including device type;

  • Photos with recognizable individuals during our events and for marketing purposes;

  • Business information such as a business email address, job title, business address (for self-employed individuals) and billing details.

Photos/videos

During (public) events of the ChipNL Competence Centre, photos and/or videos may be taken. These may be published at a later time on our website and/or social media channels. Photos and videos will be published in accordance with the purpose for which they were taken.

What do we need your personal data for?

The ChipNL Competence Centre processes your personal data only if we have a reason to do so. This is also known as a specific purpose. For example, we process your personal data for:

  • Sending our newsletters;

  • Sending invitations for events;

  • Analyzing activities on our website in order to improve the website and tailor the offering of products and services to your preferences;

  • Connecting companies, organizations, and individuals within the Dutch and international chip industry;

  • The recruitment and selection of personnel and the maintenance of the personnel file.

We specify in advance for which reasons (purposes) we need your personal data. We do this as clearly as possible. In addition, we only collect the personal data that is necessary for that purpose.

In some cases, it is necessary to share your personal data with other parties. We only do this when required by law, for the performance of a contract, or if there is a legitimate interest. We make agreements with the parties with whom we share your personal data.

On what grounds do we process your data?

The ChipNL Competence Centre does not process your personal data just like that. We only process your personal data when we can base it on a legal ground. The GDPR mentions the following six legal grounds on which we may process your personal data:

  • Permission, for example when you have signed up for our newsletter. You can always withdraw your permission.

  • Performance of a contract, for example within the framework of an employment contract.

  • Legal obligation, for example providing data to the Tax Authorities.

  • Protection of vital interests, for example when it comes to someone's life or health.

  • Having a task of general interest or in the exercise of public authority.

  • Legitimate interest, for example for the proper performance of services.

How long do we keep personal data?

We do not store your personal data longer than necessary. For this purpose, we use legal retention periods, establish retention periods, or use established criteria. Your personal data will be destroyed after this period. Some examples of this are:

  • Personal data of unsuccessful job applicants will be deleted at the end of the application process, unless the applicant requests to keep it for a longer period.

  • Personal data processed in the context of grant applications will be deleted after the agreed retention period and the obligations imposed by the grant provider.

  • Personnel files are removed two years after leaving the company, except for the data that is necessary to comply with legal obligations, such as the income tax declaration.

How do we secure your data?

We consider it important that your personal data is well protected. To achieve this, we implement technical and organizational security measures. Additionally, we ensure that the individuals working within the ChipNL Competence Centre handle personal data safely, carefully, and responsibly.

What rights do you have as a data subject?

If the ChipNL Competence Centre processes your personal data, you also have certain rights under the GDPR. You have the following rights:

Right to access
You have the right to inquire at the ChipNL Competence Centre whether your data is being processed, what personal data is involved, and why it is being processed. You have the right to access this personal data and receive a copy of the personal data we process about you.

Right to rectification and supplementation
You can ask the ChipNL Competence Centre to adjust or supplement your data if the personal data we process about you is not (anymore) correct or complete.

Right to erasure of your data (right to be forgotten)
You can ask the ChipNL Competence Centre to delete the personal data we have from you. In some cases, this may not be possible, for example when the data is needed to comply with legal obligations.

Right to restriction of processing
You can request the ChipNL Competence Centre to restrict the processing of your personal data. The ChipNL Competence Centre will then temporarily stop the processing of your personal data until your request is handled.

Right to data portability
You can request the ChipNL Competence Centre to transfer your personal data to another data controller (in a machine-readable format).

Right to object
You have the right to object to the processing of your personal data by the ChipNL Competence Centre. This can be done, for example, when the ChipNL Competence Centre uses your personal data for direct marketing (such as email advertising).

If you wish to exercise one or more of these rights, you can submit a request to the ChipNL Competence Centre. It is best to do this via email. Our contact details can be found under the heading 'Contact'. We can assist you best if the request is formulated as clearly and concretely as possible. You will receive a response from us as soon as possible, but no later than within one month of your request.
